The following regulations are intended to inform you about the type, the scope and the purpose of the collection, use and processing of person-specific data on the website of the 10th Berlin Biennale for Contemporary Art. Your person-specific data (e.g. e-mail) will be processed by us solely in accordance with the provisions of German and European data protection law. Data is person-specific if it can be clearly assigned to a specific natural person. You can find the legal basis of data protection in DSGVO [Basic Regulation on Data Protection], in the German Data Protection Law (BDSG) and in the German Telemedia Act (TMG).

We draw your attention to the fact that Internet-based data transfer has security gaps. Absolute protection against access by third parties is therefore not possible.

Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies.” Cookies are small text files which are saved on your computer and enable analysis of the use of a website. They are used to anonymously collect and store information on user behavior for the purpose of website optimization. It is not possible to personally identify individual visitors.

The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States.

We hereby notify you that this website uses an extension for Google Analytics, “gat._anonymizeIp();,” in order to ensure the anonymized collection of IP addresses (so-called IP masking). Google will therefore collect your IP address in truncated form only. This ensures anonymization and rules out any direct personal reference.

Due to IP anonymization, Google will truncate your IP address within the European Union Member States as well as contracting parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and truncated by Google servers in the USA. 
On behalf of the website provider, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage to the website provider. Google will not connect your IP address to any other data held by Google.

The installation of cookies can be prevented by setting your web browser to not accept new cookies, to notify you of new cookies, or to delete all cookies already received. We hereby inform you, however, that you may not be able to take full advantage of all functions of this website in this case.

Social Plugins

This website uses so-called social plugins (“plugins”) of the social network Facebook, operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, US (“Facebook”) or Facebook Ireland Limited, Hanover Reach, 5-7 Hanover Quay, Dublin 2 Ireland. The privacy policy of Facebook can be found here. The plugins are usually marked with the Facebook logo or the addition “Facebook social plugin”. Also, our website uses so-called social plugins (“plugins”) of the micro blogging service Twitter, operated by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, US (“Twitter”). You can find their privacy policy here. The plugins are usually marked with a Twitter logo, for example, in the form of a blue “Twitter bird.” You can find an overview of the Twitter plugins and their appearance here.

Further, our website uses so-called social plugins (“plugins”) by Instagram, operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, US (“Instagram”). You can find their privacy policy here. The plugins are usually marked with an Instagram logo, for example in the form of an “Instagram camera.” You can find an overview of the Instagram plugins and their appearance here.

You can use these features to share or recommend content with your friends within the respective social networks.

By using social plugins, for example the Facebook “like” button, the Instagram button, or the Twitter button, person related data may be collected in the following ways:

By visiting a page of our website that contains a social plugin, your browser establishes a direct connection to the servers of Facebook, Twitter, and Instagram. The social network directly transfers the plugin content to your browser which embeds the latter into the website. This way, the social network receives information about your browser with your IP address/device number having accessed the respective page of our website. This happens irrespective of whether you are actually connected to, or even registered for, the social network. The information (including your IP address) is transmitted from your browser directly to the server of the social networks in the USA and stored there.

If you are logged into the social network, your visit can be assigned to your social network account. If you interact with the respective plugins or sharing content, the corresponding information is transmitted from your browser directly to your social network and stored there.

Please note that data collected by social plugins are only exchanged between the browser and the operator of the social network. We have no knowledge of the content of the collected and transmitted data.

Please refer to the privacy policies of the social networks for the purpose and scope of data collection and their further processing and use of data.

You can completely revoke the collection of data by Facebook plugins by using so-called add-ons for your browser, for example “Facebook Blocker”.

If you wish to completely prevent loading the Twitter and Instagram plugins, you can set add-ons for your browser, for example the script blocker “NoScript”.

NEWSLETTERS

We send necessary mailings on the accreditation for the 10th Berlin Biennale to registered users via Accredate. Such mailings include confirmation of receipt of the accreditation enquiry, confirmation of the accreditation with access codes to the preview days, notification of refusal of accreditation, general information on the preview and invitations to events.

On the Berlin Biennale website you have the possibility of subscribing to the Berlin Biennale newsletter, as well as to the newsletter of KW Institute for Contemporary Art. Both newsletters are sent via the service Newsletter2Go.

With the newsletters we provide information at regular intervals about the program and the activities of the Berlin Biennale for Contemporary Art and/or KW Institute for Contemporary Art. To be able to receive these mailings you need a valid e-mail address. The e-mail address given by you will be checked to ensure that you are indeed the owner of the given e-mail address, or that its owner has authorized receipt of the mailings. To this end, after sending your newsletter subscription enquiry, you will receive an e-mail at the given address with a request for confirmation. You can cancel the subscription to the newsletter and to the press releases at any time.

RIGHTS OF PERSONS AFFECTED

You have the right:

in accordance with art. 7, paragraph 3 of the basic regulation on data protection, DSGVO, to revoke your previously given consent, with respect to us, at any time. This has the consequence that, from that point in time, we will no longer be entitled to undertake the data processing dependent on this consent;

in accordance with art. 15 of DSGVO, to demand information on your person-specific data processed by us. In particular, you can demand information on the purposes of the processing, the category of the person-specific data, the categories of recipients with respect to your data has been or will be disclosed, the planned period of storage, the existence of a right to correction, deletion, limitation of the processing or contradiction, the existence of a right of objection, the origins of your data, if this has not been collected by us, and about the existence of an automated decision-making process including profiling and, where applicable, sound information on the related details;

in accordance with art. 16 of DSGVO, to demand the immediate correction of incorrect data or the completion of your person-specific data stored by us;

in accordance with art. 17 of DSGVO, to demand the deletion of your person-specific data stored by us, provided the processing is not necessary for the exercising of the right to free expression of opinion and information, for the fulfilment of a legal obligation, for reasons that are in the public interest, or for assertion, exercising or defence of legal entitlements;

in accordance with art. 18 of DSGVO, to demand limitations on the processing of your person-specific data, if the correctness of the data is contested by you, if the processing is unlawful but you reject the deletion of the data and we no longer require it, but you need it for assertion, exercising or defence of legal entitlements, or if you have protested against the processing, in accordance with art. 21 of DSGVO;
in accordance with art. 20 of DSGVO, to demand to be sent your person-specific data, that you have provided us with, in a structured, standard and machine-readable format, or its transfer to another responsible body.

RIGHT OF OBJECTION

If your person-specific data is processed, on the basis of justified interests in accordance with art. 6, paragraph 1, sentence 1, letter f of DSGVO [Basic Regulation on Data Protection], you have the right, in accordance with art. 21 of DSGVO, to protest against the processing of your person-specific data, provided reasons exist that arise from your special situation.
